Welcome to Pick Tuber. These Terms of Service govern your access to and use of the Pick Tuber mobile application ("App") provided by Shadman IT Solutions. By downloading, installing, accessing, or using Pick Tuber, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.
1.1 Pick Tuber is a video application that provides users with video-related services, features, and content experiences. The available features may include video browsing, viewing, sharing, uploading, interaction, and other functions that we may introduce or update from time to time.
1.2 We reserve the right to modify, suspend, or discontinue any part of the App or its features at any time without prior notice when necessary.
2.1 By accessing or using Pick Tuber, you confirm that you have reached the minimum legal age required to enter into a binding agreement in your country or region, and that you have the legal capacity to accept and comply with these Terms.
2.2 If you are under the applicable legal age, you may only use Pick Tuber with the permission and supervision of a parent or legal guardian. Your parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the App.
2.3 You represent and warrant that you have the authority and ability to enter into these Terms and that your use of Pick Tuber does not violate any applicable laws, regulations, or obligations.
2.4 If we become aware that a user does not meet the required eligibility requirements, we may restrict, suspend, or terminate access to the App and related services.
3.1 Some features of Pick Tuber on Android may require you to create an account or provide certain information. You are responsible for maintaining the accuracy of your account information and keeping your account secure where applicable.
3.2 You agree that you are responsible for all activities performed through your account (if available) and must immediately notify us if you become aware of any unauthorized access or security issue.
3.3 You must provide accurate information and must not use another person's identity or account without permission.
Pick Tuber is a local media player. You may import, access, or play video, audio, and other media files stored on your local device ("Local Content"). Pick Tuber does not upload, store, host, or sync your Local Content to any remote servers.
You retain full ownership and control over your Local Content. Pick Tuber claims no ownership or licensing rights to your files. The app processes, decodes, and renders your Local Content strictly on your local device solely as necessary to provide playback functionality.
You are solely responsible for the Local Content you import or play using Pick Tuber. You must ensure that your media files and usage comply with all applicable laws and do not infringe upon any third-party intellectual property, privacy, or legal rights.
5.1 Please use Pick Tuber responsibly and in accordance with these Terms. You are expected to behave appropriately and respect other users, the platform, and applicable laws when using the App. When using Pick Tuber, you agree not to:
5.2 We reserve the right to restrict access, or suspend accounts that violate these Terms.
6.1 All rights, title, and interest in Pick Tuber, including but not limited to software, design, trademarks, logos, graphics, and related materials, are owned by or licensed to Shadman IT Solutions. Your use of the App does not grant you any rights, title, or interest in the App or any of its intellectual property.
6.2 You may not copy, modify, distribute, reverse engineer, sell, or exploit any part of the App without our prior written permission.
7.1 Pick Tuber may include third-party services, advertisements, links, or integrations provided by external companies. These third parties may have their own terms and privacy policies.
7.2 We are not responsible for the availability, accuracy, content, products, or services provided by third parties.
7.3 Your interactions with advertisements or third-party services are solely between you and the relevant third party.
8.1 Pick Tuber is provided on an "as is" and "as available" basis. While we make reasonable efforts to maintain the reliability and quality of the App, we do not guarantee that the App will always be uninterrupted, error-free, secure, or available at all times.
8.2 We do not guarantee the accuracy, completeness, or reliability of any user-generated content or third-party content available through the App.
9.1 To the maximum extent permitted by applicable law, Shadman IT Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Pick Tuber.
9.2 You are responsible for your own use of the App and any consequences resulting from your actions.
Pick Tuber strictly prohibits the use of the app to play, view, or process any content involving child sexual abuse material (CSAM), child sexual exploitation, or any form of harm to minors. We maintain a zero-tolerance policy against the use of our app for illegal activities involving minors.
You are solely responsible for ensuring that all media files processed through Pick Tuber comply with child protection laws in your jurisdiction. Possessing, generating, or accessing unlawful content involving minors on your local device using Pick Tuber is strictly prohibited.
While Pick Tuber does not host, upload, or monitor your local files, we reserve the right to cooperate fully with law enforcement agencies or authorities if compelled by legal process regarding illegal activities involving minors.
11.1 To provide a better user experience, improve security, fix errors, introduce new features, and maintain compatibility with updated operating systems and services, Pick Tuber may release updates from time to time.
11.2 Updates may include improvements to application performance, security enhancements, bug fixes, changes to existing features, new features, modifications to user experience, and other improvements necessary for the operation of the App.
11.3 We may provide optional or mandatory updates depending on the importance of the changes. Certain updates may be required to continue using Pick Tuber or specific features of the App. If you choose not to install available updates, some functions or services may become unavailable, limited, or may not work properly.
11.4 You are responsible for keeping Pick Tuber updated to the latest available version to ensure the best experience, security, and compatibility. We are not responsible for issues caused by your failure to install necessary updates.
12.1 We may update these Terms from time to time due to changes in our services, legal requirements, or business operations.
12.2 Updated Terms will be posted with a revised effective date. Your continued use of Pick Tuber after changes are made means you accept the updated Terms.
